1. Scope

These Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.


2. Contract Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with HealPure (tryhealpure.com).

By placing products in our online shop, we make a binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process.

The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.


3. Contract Language, Storage of Contract Text

The language available for concluding the contract is English.

We store the contract text and send you the order data and our Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.


4. Delivery Conditions

We deliver worldwide. Shipping costs and delivery times are displayed during the checkout process.

Delivery is made by shipment only. Unfortunately, self-collection of the goods is not possible.

We do not deliver to packing stations.

No refund will be issued if the goods are not accepted. The goods must be properly accepted and returned within 14 days to the return address provided by us in order to receive a full refund of the purchase price.


5. Payment

The following payment methods are generally available in our shop:

Credit Card
When placing your order, you provide your credit card details. After verification as the legitimate cardholder, the payment transaction is carried out automatically and your card will be charged.

PayPal
During the ordering process, you will be redirected to the PayPal website. To pay via PayPal, you must be registered there or register first, authenticate yourself with your login details, and confirm the payment instruction. After placing the order, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately thereafter.

Sofort by Klarna
After placing your order, you will be redirected to the Sofort GmbH website. To pay via Sofort, you must have a bank account enabled for online banking, authenticate yourself accordingly, and confirm the payment instruction. The payment transaction is carried out immediately and your account is charged.


6. Retention of Title

The goods remain our property until full payment has been made.


7. Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay.

Failure to make a complaint or contact us does not affect your statutory rights and their enforcement, particularly your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance.


8. Warranty and Guarantees

The statutory liability for defects applies.

9. Liability

We shall be liable without limitation for claims arising from damages caused by us, our legal representatives, or agents:

  • in the event of injury to life, body, or health
  • in the event of intentional or grossly negligent breach of duty
  • in the case of guarantee promises, where agreed, or
  • insofar as the scope of application of product liability law is opened

In the event of a breach of essential contractual obligations (cardinal obligations), the fulfillment of which is necessary for the proper execution of the contract and on whose compliance the contractual partner may regularly rely, due to slight negligence by us, our legal representatives, or agents, liability is limited to the foreseeable damage at the time of conclusion of the contract, the occurrence of which must typically be expected.

Otherwise, claims for damages are excluded.


10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find online.

We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
